Terms of use

I. When using the ODEXPO services, you accept without reservation the terms of use stated hereunder. These terms concern every ODEXPO service (especially the Odexpo web site and the Direct Sale package). II. These terms of use may be updated anytime. The latest version can be referred to on our "Terms of use" web page. A link on each page of the Odexpo.com web site directs to the "Terms of use" page. III. ODEXPO is entitled to delete without warning or compensation every site / ad that does not in any way respect these terms of use, especially any site or ad bearing no link whatsoever with art or that have pornographic (except for artistic purposes) or unlawful content (the list is non-exhaustive). IV. When you subscribe to the services, the information you provide about yourself must be complete and accurate, and should always be updated when the need occurs. V. ODEXPO will never communicate your details or information to a third party without your authorisation mentioned in the application form you fill in. According to the "Data processing and liberties" law dated 6th January 1978, you have an access and correction right concerning your own information and details. Should you wish to use this right, do not hesitate to contact us via our contact form. VI. When you subscribe, you will be sent a password by email. This password gives you access to the admin area and can be changed in this area. You are thus responsible of the actions made on your website / ad. It is therefore recommended to change this password and to keep it confidential. VII. When creating your website / ad via its services: 1/. You shall not present several artists' works, unless you are an art gallery advertising its program. 2/. You authorize ODEXPO to create a link to your website on its home page (as an example of website created thanks to ODEXPO). VIII. When you create a website or an ad via the ODEXPO services, 1/ you are responsible of the content (text, photographs, images…) that you publish online, in a public or private way. 2/ ODEXPO cannot in any circumstances be held liable of your website / ad, particularly of an illicit content according to the law in force. 3/ ODEXPO does not bear any liability in the transactions between buyers and artists in the event of a sale via the website or an ad. ODEXPO should not in any case be held responsible of fraudulent sale. 4/ your fiscal and company status must be up to date when taking part in a sale. IX. You commit yourself to detaining all the rights and authorisations about the content displayed thanks to the ODEXPO services, especially the author's rights for texts, images or any other content displayed on your website / ad. Only you can be held liable in case of a conflict with a third party. X. You retain all the copyrights for the content of your website / ad. You alone are responsible for its protection. ODEXPO retains all the rights for the services it offers. You cannot in any circumstances reclaim the sources of that service, even in case of a definitive break of the said service. ODEXPO owns and keeps all the rights related to the Service. This includes exclusive and confidential information protected by laws on intellectual property or other laws. You are not authorised to copy, modify, publish, transmit, distribute, present, display or sell exclusive information belonging to ODEXPO without its authorisation. XI. You will not publish on your website / ad racist comments, or comments suggesting violence or discrimination, slanderous, pornographic or paedophiliac comments; comments that damage human dignity, private lives or copyrights (intellectual creation, brands) and broadly speaking contrary to good practices and public order laws. XII. You will not publish on your website / ad a pornographic content or links to pornographic websites. The erotic aspect of some artworks will be judged by the ODEXPO team. You will not include on your site, in any form whatsoever, paid advertisements from sites of affiliations (Adsense or other type) or enter any scripts that may cause malfunction of the service; XIII. ODEXPO is entitled to modify, suspend or delete without notice or compensation all or a part of your website if these conditions are not respected. XIV. ODEXPO is not allowed to see the content of your website / ad before it is published online. However, should a dispute take place, ODEXPO or any of its representatives is entitled to access your website offline, whether be it public or private. XV. Along with the information you enter on the online form, ODEXPO will keep your IP address and the date and time of your subscription. These data will be given to the proper authority, should a dispute take place. XVI. You undertake to defend and compensate ODEXPO in case of a dispute with a third party following your use of the service or linked in any way with the service. XVII. You can stop using the ODEXPO services: - Anytime and without delay. You can delete your website / ad in the admin area. The subscription paid for a website / ad package will then be lost and will not be refunded. - By asking so via the contact form. A reasonable notice should be given. ODEXPO holds the right to stop definitely or for a short period of time one or all the services it offers without prior notice or reimbursement. XIX. You recognise and acknowledge that: 1. The service is supplied "as is" in working order. It is accessible accordingly to its availability. ODEXPO cannot guaranty for example the quality and compatibility of the service for a specific use and the breaking of the terms of use of the service by its users. 2. ODEXPO does not guaranty that (i) the service will exactly fulfil your expectations, (ii) the service will be uninterrupted, opportune, safe or mistake free, (iii) the results obtained while using the service are true and reliable, (iv) the quality of all the products, services, information or any other product you obtained via the service will fulfil your expectations, (v) the imperfections in the offered services will be corrected. 3. Every object downloaded or gained in an other way while using the service is done so at your own risk. You only will be responsible for any damage caused to your computer or any data loss following the downloading of these objects. 4. No advise and no information, either verbal or written, you received from ODEXPO or via the use of the service can in any case create guaranties foreseen by the present terms of use. XX. You acknowledge and accept that, in the scope allowed by the law up to date, ODEXPO cannot be held responsible for any direct or indirect damage, especially losses of profit, clients, data or other immaterial goods (even if ODEXPO has been informed that such damages can occur) that can take place during the following events: (i) if one uses or cannot use the service, (ii) the cost of the acquisition of substitute goods or services following the purchase of goods or services or the reception of messages or transactions that occurred during the use of the service, (iii) following an unauthorised access to the service by a user or a modification of your transmission or your databank, (iv) following a declaration or the behaviour of a third party about the service and (v) any other matter relating to the service.
